عريضة لمساندة النقابي الجزائري رؤوف ملال -----------------petition to support the Algerian unionist Raouf Mellal Pétition contre la condamnation du syndicaliste algérien Mellal Raouf

بعد ان نجح رئيس النقابة المستقلة لعمال الكهرباء في الجزائر النقابي رؤوف ملال بتصحيح خطأ كانت تمارسه شركة سونلغاز بحق المواطنين، يتمثل بتضخيم قيمة فواتير الكهرباء، كان جزاءه الحكم عليه غيابيا، من قبل محكمة "قالمة" للجنح بالحبس ستة اشهر بعد ان تقدمت شركة سونلغاز بشكوى ضده بتهمة "الحصول على وثائق سرية بطرق غير قانونية" من الشركة.

وفي الوقت الذي اصدرت فيه المحكمة قرارها غيابيا، رغم طلب ملال عرض تلك الوثائق، التي تم اتهامه انه حصل عليها بطرق غير قانونية، عليه، ليتسنى له الدفاع عن نفسه، تؤكد الوثائق المنشورة ان شركة سونلغاز تلاعبت بقيمة الفواتير واجبرت المواطنين على دفع مبالغ اضافية على قيمة الفواتير. الاتحاد العربي للنقابات يستهجن ما تعرض له النقابي ملال، ويدعو الى إحترام الدستور بخصوص الحق النقابي و الحرية النقابية و إحترام الإتفاقيات الدولية المصادق عليها من طرف الدولة الجزائرية بخصوص حماية ممثلي العمال و النقابيين إتفاقية رقم 135 معتبرا ما حدث مع الزميل النقابي ملال خرقا لاتفاقيتي منظمة العمل الدولية 87 و 98 . وفي سياق تنديد الاتحاد العربي للنقابات بالاجراء القمعي بحق النقابي ملال يرفض تلفيق التهم له ويطالب بالغاء الحكم الصادر بحقه، ويدعو كافة النقابات والعمال في كافة ارجاء العالم لمساندته عن طريق توقيع هذه العريضة الداعية الى رفع الظلم الذي لحق بالنقابي ملال

After the Chairman of the Independent Union of the Electricity Workers in Algeria unionist Raouf Mellal successfully exposed the illegal practice by Sonelgaz company that were inflating the value of the electricity bills, he was sentenced in absentia by a local court for six months in prison.

This came after Sonelgaz Company filed a complaint against him on charges "obtaining secret documents illegally" from the company. The court issued its decision in absentia, despite a request from Malal to display those documents, to allow him to defend himself, and to confirm that Sonelgaz company manipulated the value of the invoices, and forced citizens to pay extra on bills. Arab Trade Union Confederation denounces what Malal suffered, and calls for respect for the constitution concerning the right and freedom of association and respect of international conventions concerning the protection of workers' representatives and trade unionists Agreement No. 135 ratified by the Algerian state.

considering what happened with fellow Malal is a breach of ILO Conventions 87 and 98. Arab Trade Union Confederation also condemns the repressive action against Malal, and refuses to fabricate charges on him and demands the court to cancel its decision against him, and calls on all unions and workers all over the world to support his case by signing the petition to lift the injustice against Mellal.

La président du syndicat national autonome des travailleurs de l’électricité et gaz SNATEGS Algérie, vient d’être condamné à 6 mois de prison ferme par le tribunal de Guelma (500km à l’Est d’Alger).

A la suite de la dénonciation d’une surfacturation sur la consommation des clients de la SONELGAZ, le groupe à porté plainte contre Mellal Raouf pour vol et divulgation de documents confidentiels auprès du tribunal de Guelma.

Condamné par contumace sur la base de fausses accusations lors d’un procès injuste ou les juges ont refusé d’exposer la preuve du délit car inexistante.

La CSI Arabe condamne fermement ce procès injuste contre Mellal et appelle au respect des droits syndicaux et des libertés syndicales conférés par les conventions internationales de l’OIT, ratifiées par l’Algérie.

La CSI considère que la condamnation du camarade Mellal est une violation des conventions internationales : 135 la C87, et la C98 de l’OIT.

La CSI, considère également que la le procès intenté contre Mellal Raouf est une mesure judiciaire répressive, montée de toutes pièces, visant à écarter Mellal du SNATEGS qui gagne du terrain

La CSI demande l’annulation de la condamnation du syndicaliste Mellal et appelle à la solidarité internationale de tous les travailleurs et les syndicats internationaux à signer cette pétition, pour exiger la levée de la condamnation

El presidente del Sindicato Independiente de Trabajadores de la Electricidad de Argelia, Raouf Mellal, fue condenado a seis meses de prisión por revelar una práctica fraudulenta de la empresa Sonelgaz para aumentar el valor de las facturas de electricidad.

Esto ocurrió después de que Sonelgaz Company presentara una queja contra él por cargos de "obtener documentos secretos ilegalmente" de la compañía. El tribunal emitió su decisión in absentia, a pesar de la solicitud de Malal de que dichos documentos fueran revelados con el fin de defenderse y confirmar que la empresa Sonelgaz manipulaba el valor de las facturas forzando a los ciudadanos a pagar más.

La Confederación Sindical Internacional - Árabe (CSI-Árabe) ha denunciado estos hechos y pide que se respete la Constitución, el derecho a la libertad sindical y el convenio 135 de la OIT, ratificado por el Estado argelino, relativo a la protección y facilidades que deben otorgarse a los representantes de los trabajadores.

Lo sucedido con el compañero Malal es una violación a los convenios 87 y 98 de la OIT. La CSI-Árabe considera que esta medida judicial fue fabricada con fines represivos y exige al tribunal que anule su decisión. Exhortamos a todo el movimiento sindical a demonstrar su solidaridad firmando la petición exigiendo el fin de la injusticia contra el compañero Mellal.
