It is a proven fact that all employees respond well and are more productive when their hard work is acknowledged by a supervisor. It is equally beneficial for a supervisor to offer encouragement when an employee makes reasonable mistakes. Non-disabled employees have the advantage of possessing self-confidence and are therefore not left vulnerable due to a lack of positive support. However, employees with a mental disability need a significant amount of praise and encouragement to perform their responsibilities in accordance to company standards. This petition is requesting that two additional rules in regards to people with mental disabilities be added to The Fair Employment and Housing Act (FEHA) 1) We want “praise and encouragement from employees in a supervisor position(s)” to be designated as a “reasonable special accommodation” and 2) We are requesting that employers implement a more complex disability sensitivity training course instead of the superficial cursory one they currently use which mentions nothing about mental disability and we want it to emphasize the importance of fair and positive treatment of employees who have a mental disability.

We, the undersigned, petition The Department of Fair Employment and Housing and The Fair Employment and Housing Act (FEHA) to amend their mandatory training requirements for new hires and employees going into a supervisor/management position to have no less than 2 hours of disability sensitivity training without any other subject matter or issues that are not appurtenant to disability sensitivity training being discussed during this time. We want to replace current disability sensitivity training courses with those that are more complex and specific especially in regards to the treatment of employees with a mental disability. We want the new training to emphasize the importance of fair and positive treatment of employees who have a mental disability. We further want the Act to state:

“A significant amount of praise and encouragement by employees in a supervisor/management position(s) is to be given to subordinates who request this accommodation based on the quality of their job performance."

We want this second request to be designated as a "reasonable special accommodation."
