Toll Dnata members are now at least being paid in accordance with the Award, following a determination by the Workplace Authority’s that the contracts failed the No Disadvantage Test in September 2008.
ASU members are waiting for a determination from the Workplace Ombudsman about possible breaches of the Workplace Relations Act 1996 (Cth) by Toll and the full amount of underpayments of wages owed to them as a result of the agreements having failed the no disadvantage test.
The fight for a collective agreement, with conditions similar to other airlines workers, continues.

The ASU has launched a petition to support Toll Dnata workers at Australian airports and protect the industry from a drop in standards.
Aviation workers at Australian airports are being asked to sign the petition to protect their industry wages and conditions and to make sure the Rudd Government is alerted to the situation.
New employees at Toll Dnata are being offered individual contracts with a flat rate of $20 per hour for all shifts; no shift penalties or allowances and they are only paid overtime after 1,786 hours per year.
The ASU does not want to see Toll Dnata set a new, lower standard and under-cutting other companies in the industry that are paying their employees appropriately.
The ASU wants to gather 1,000 signatures over the next two weeks.
The petition, addressed to Deputy Prime Minister and Minister for Employment and Workplace Relations, Julia Gillard and members of the Labor Industrial Relations Committee members.
The petition reminds the Rudd Government that Australians voted against Work Choices at the last election and asks for a change in IR laws.

We, the undersigned aviation workers, are concerned about the employment practices of Toll Dnata Airport Services. This company has hired employees to do work for overseas airlines on sub-standard individual contracts, paying a flat rate of pay for shift workers without adequate compensation for Award conditions.
As the Minister, we seek your immediate intervention into this case to ensure that Australians working in the aviation industry do not have their wages and conditions undermined by renegade employers who race to the bottom to increase profits.
We remind you that Australians voted against Work Choices last election and we call on the ALP to make real changes to the Work Choices laws to stop this from happening to Australian workers in the future.
