We were successful. On the 29th May the Deputy Prime Minister directed the Industrial Relations Commission to establish a separate award for restaurants, cafes and caterers.

As part of the Forward with Fairness Policy that the Rudd Government took to the 2007 Election, there was a proposal to modernise and simplify industrial awards. This proposal was based on building awards from the ground up to suit the industries to which they would apply. The Ministerial request and the legislation state that the modern awards should be sustainable and not cost employers financially.
In December 2008 an award was handed down by the Australian Industrial Relations Commission to cover restaurants and caterers. The award is an exact copy of the current hotels award. It has conditions that stem from hotel practices of old (such as the 6 o'clock swill and exclusive Sunday trading). These are now to be applied to restaurants across Australia.
Restaurant & Catering Australia estimates that this move will cause 8,000 jobs to be lost to the economy, 1,000 restaurants to go out of business and 50% of the balance to cease to be viable.
We, the undersigned, call on the Australian Government to demand that the Australian Industrial Relations Commission withdraw restaurants from the coverage of the Hospitality Industry (General) Award 2010 and provide an award for the restaurant industry that will meet the objective of not providing a cost impost on employers.
