We, the residents of the Hamlet of Presho, Town of Lindley and surrounding roads, oppose the possible zoning change of Presho School Road, County Route 5 also known as Clendenning Creek Road and Smith Road, and County Route 115. Currently the Hamlet and Town are zoned as follows: Residential/Agricultural. The zoning change will make all 37 parcels zoned Mixed-Use.

We oppose this zoning change. We don't understand why The Town of Lindley wants to do away with the Residential homes and rural characteristics of our Town as stated in the newly adopted Comprehensive Plan.

Most parcels as currently zoned would allow no more than 1 home on a parcel less than 2 acres. Any developer or business owner that petitioned the Town to allow the construction of an allowed use or change the characteristics of an existing home would create an unwanted, high density project totally out of character with the neighborhood. It also would create a parking dilemma, excessive noise and traffic for home owners in and adjacent to the proposed project. The areas within the proposal are known as “Dense Residential” areas, meaning, an estimated 97% of these parcels are Residential homes.

Mixed Use Zoning as defined by the State of NY reads, “Mixed-use zoning blends a variety of land uses together in one area. Single-family detached homes of various sizes, townhouses, apartments, and condos; retail stores, restaurants, and services; and civic and cultural amenities might all be located within walking distance of each other. Mixed-use zoning is typical in traditional cities, villages, and hamlets that were developed in the early 20th Century.” This does not define the Hamlet of Presho at all. Proposed Mixed-Use Zones in the surrounding Towns however do, for example, the four corners in Savona, Historical Market Street in the city of Corning, Liberty Street in the Village of Bath. But our closest neighbors, Caton, Hornby and Addison do not have a mixed use zone.

We, the residents agree that the Presho exit location is not prime land as read in the current Comprehensive Plan. The parcels are too small, they are on a private well and septic, most parcels are not visible to the interstate and with the Addison exit having 1 filling station and a new truck stop being constructed and the Lawrenceville exit having another truck stop, there is no interest in people stopping at our exit when they can obtain all the necessities at the Erwin exit for food, shopping and the next 2 exits for fuel.

We the undersigned strongly oppose the possible zoning change of Presho School Road, County Route 5 also known as Clendenning Creek Road and Smith Road, and County Route 115.

We further recommend that the Town change the zoning on only one parcel. After consulting with Amy R. Dlugos, Director of Planning with Steuben County, a locality can lawfully rezone a single parcel if its action is shown to be consistent with the community's land use policies. As the Town is proposing presently, the rezoning will permit land uses not available to the adjacent properties and is then defined as “spot zoning”.
