According to Ontario Law, the mother of a child born to parents that have not lived together and are separated at the time of birth is given full custody of the child under the rule of de facto custody.
This gives the mother full custody rights while virtually removing all rights the father has for caring for, or being involved in the life of their child. Many mothers are aware of this law and abuse it as a means of denying a father's involvement in their child's life.
I am a new father who is being denied access and information about the well-being of my son by a person who is well acquainted with this law as well as various other government programs of which she is manipulating to her advantage.
Fathers in this situation who want equal rights, responsibilities and time with their children are usually forced to start formal court proceedings which can take anywhere from months to close to a year before being able to have their case heard in family court and finally be granted any access whatsoever to their child.
We, the undersigned, call on the Parliament and Government of Ontario to repeal the law of de facto custody and call for new laws that can not result in the oppression of a father's rights by a mother enforcing the rule of de facto law.
