We, the undersigned, call upon the current Governor of the State of New York to sign the following Executive Order.

PROHIBITING VACCINE MANDATES AND MEDICAL DEVICE MANDATES IN THE STATE OF NEW YORK

WHEREAS, the former State of New York governor (Andrew Cuomo) signed the New York state on PAUSE Executive Order on March 2020.

WHEREAS, the 2020 lockdown due to the declared COVID-19 pandemic has caused many undue hardships on the State of New York residents, businesses, employees, employers and therefore the state itself.

WHEREAS, the 2020 lockdown due to the declared COVID-19 pandemic has caused job loss in the hundreds of thousands which resulted in a high unemployment rate.

WHEREAS, the 2020 lockdown due to the declared COVID-19 pandemic has caused hundreds, possibly in the thousands, of small businesses in the State of New York to permanently close because of the 100% Closure of Non-Essential Businesses Statewide implemented in March 2020.

WHEREAS, the 2020 lockdown due to the declared COVID-19 pandemic has caused many State of New York residents to miss crucial doctor appointments, such as cancer treatments and screenings.

WHEREAS, the above hardships must be avoided at all costs, for the benefit of the State of New York residents, businesses, employees, employers, and therefore the state itself.

WHEREAS, as of November 11, 2021, according to health.ny.gov, 75.3% of residents all ages eligible for the vaccine have at least one dose, and 67.3% are fully vaccinated. This leaves 24.7% State of New York residents all ages who are eligible, not vaccinated.

WHEREAS, as of November 11, 2021, according tohealth.ny.gov,88.7% of residents who are adults have at least 1 dose, 79.5% are fully vaccinated. This leaves 20.5% State of New York adults not vaccinated.

WHEREAS, on August 16, 2021, the former State of New York governor (Andrew Cuomo) announced all healthcare workers in New York State, including staff at hospitals and long-term care facilities (LTCF), including nursing homes, adult care, and other congregate care settings, will be required to be vaccinated against COVID-19 by Monday, September 27. The State Department of Health will issue Section 16 Orders requiring all hospital, LTCF, and nursing homes to develop and implement a policy mandating employee vaccinations, with limited exceptions for those with religious or medical reasons.

WHEREAS, the current mayor (Kathy Hochul), signed Executive Order No.4 “Declaring a Statewide Disaster Emergency Due to Healthcare Staffing Shortages in the State of New York”.

WHEREAS, The State Department of Health issuing Section 16 Order is the direct reason for healthcare staff shortages.

WHEREAS, many New Yorkers who are vaccinated felt coerce into receiving the COVID-19 vaccine, over fear of losing their livelihoods because they object to receiving a Covid-19 vaccine.

WHEREAS, as of November 5, 2021, the CDC has reported “protection against the virus may decrease overtime” referring to those who are vaccinated. Many New Yorkers who are already vaccinated fear the “booster shot” may be mandated in the future. Receiving the booster shot should remain a choice.

WHEREAS, many New Yorkers whom are not vaccinated also fear losing their livelihoods because they object to receiving a Covid-19 vaccine.

WHEREAS, many New Yorkers feel coerce into receiving a COVID-19 test, over fear of losing their livelihoods because they object to receiving a Covid-19 test. This should always be a choice.

WHEREAS, many New York parents are concerned with their child wearing a mask while attending school, in which this should be the parent’s choice. As well as many employers and employees do not want to wear a mask, this should be their own choice.

NOW, THEREFORE, I, [current governor], Governor of the State of New York, by virtue of the authority vested in me by the Constitution and laws of the State of New York, do hereby find any form of mandate regarding COVID-19 vaccine, COVID-19 vaccination proof, COVID-19 testing, or wearing of a mask towards any individual to not be in the best interest of the State of New York . This Executive Order shall remain in full force and effect until otherwise revoked, superseded, or modified:

FURTHER, no entity in the State of New York can mandate a COVID-19 vaccine, COVID-19 vaccination proof, COVID-19 testing, or wearing of a mask towards any individual, who objects to such vaccination or medical device for any reason of personal conscience, based on a religious belief, or for medical reasons, including prior recovery from COVID-19.

IN ADDITION, by virtue of the authority vested in me by Section 29-a of Article 2-B of the Executive Law, all entities in the State of New York will be mandated to implement freedom of choice regarding COVID-19 vaccine, COVID-19 vaccination proof, COVID-19 testing, or wearing of a mask for all individuals. This executive order shall supersede any other conflicting executive order, policy, or law and will take effect immediately.
