The Town of Amherst, New York improperly approved a resolution to override NYS Local Property Tax Cap Limit of 2% on November 9, 2023 due to bypassing the Amherst Town Board Rules of Order for "Public Expression". This eliminated the public from commenting on the Resolution that was passed to implement a new local law permitting the Town to raise property taxes by 11.42%. This is in clear violation of the Town's rules for conducting Public Meetings.
We, the undersigned residents of the Town of Amherst are petitioning the Amherst Town Board to rescind the override of the New York State Local Property Tax Cap Limit of 2% established in General Municipal Law §3-C. The notice of a “Special Town Board Meeting” that was held on November 9, 2023 at 4:30pm was posted on the Town of Amherst’s “Track Us” page on November 7, 2023. The Town’s “Track Us” webpage does not provide RSS feed or any other alerts to notify residents of new updates to the page. A 2-day notice is insufficient to notify town residents of a proposed new law that would have a significant financial impact all property owners in the Town of Amherst.
On November 9, 2023 during the “Special Board Meeting” the Town Board passed Resolution 2023-843 to override the NYS 2% Tax Cap Limit. The new law that imposes a property tax levy of 11.42% was passed without proper input from the Town’s residents due to Supervisor Kulpa and other Board Members denying residents to speak. This is a direct violation of the Town of Amherst Town Board Rules of Order which clearly states that all public meetings provide for “Public Expression”.
