According to Article 3.17 of the City Charter of Phenix City (Pg 88) it states "No resolution or ordinance granting any franchise, appropriating any money for any purpose, providing for any public improvements, any regulation concerning the public health, or of ANY OTHER GENERAL OR PERMANENT NATURE SHALL BE ENACTED EXCEPT AT A REGULAR PUBLIC MEETING OF SAID COUNCIL"
The water merger announced Tuesday, October 30th 2007 was passed during a "Closed" session of council and NOT a public meeting. The public meeting several months previous on this matter was attended in full and most were OPPOSED to this merger. This merger was passed unlawfully under the City Charter.
We, the undersigned voters, call on the City of Phenix City Council, City Manager, & Mayor to put this Water Merger with Russell County & Ft. Mitchell to a vote so that the voters of this city can decide this matter correctly, as allowed by the City Charter.
