At Mary's Manager, we offer assistance to women who are suffering or have suffered intimate partner abuse. All of our applicants are also mothers. Kenyan law holds that custody of children of tender years ought to be granted to their biological mothers except where dis-entitling factors exist. Abused mothers stay in abusive relationships because of fear of what could happen should they leave. Their greatest fear is being separated from their children. Most abused mothers have no confidence at all in our judicial system which is notorious for laxity and corruption. Many therefore stay 'for the sake of the children'. Members of the Kenyan public must therefore arise and make known the plight of our abused mothers whose lives are being destroyed right before our eyes and whose children will most likely grow up to become abusers or to themselves suffer abuse. If you have an experience of abuse or you know someone who has, we urge you to support this worthy cause by signing this petition.
We, the undersigned, call on the Judiciary Ombudsman, whose mandate is to receive consider and process grievances against the Judiciary of Kenya, to immediately launch an investigation into multiple cases of grant of child custody and grant of unlimited visitation rights to abusive husbands in the absence of factors dis-entitling biological mothers to custody and to make the following recommendation:-
That the Honourable Chief Justice do issue practice directions to the Childrens' Court and the Family Division of the High Court requiring that where any order or decree is made denying a biological mother custody of her children, any application for review filed pursuant to such an order or decree be heard and determined within fourteen (14) days from the date of such order or decree and any formal application for stay of such an order or decree pending the hearing and determination of an appeal lodged be heard within twenty one (21) days.
