This petition serves as notice to The President of The Republic of South Africa that we the undersigned are hereby making a lawful application to have the Affirmative Action Policies of South Africa repealed.
We understand that we are a society that has been divided by the policies of apartheid and that there is much work to be done to try and balance the inequalities of the past.
We believe that Affirmative Action has played a role to uplift those who were denied the right to participate in the economy of South Africa under apartheid. We do not believe that Affirmative Action has a further role to play in the economic upliftment of individuals that have still not managed to find their place in the workforce after 14 years of ANC rule.
We believe that AA needs to be replaced with a special program that focuses on pro-actively uplifting these individuals, rather than one which simply limits the rights of non-blacks in order to give blacks the advantage.
In terms of section 9(1) of the constitution we are placing the onus on the govt to prove that the continued existence of AA is fair and reasonably justified; and to show proof that AA continues to achieve a legitimate government objective.
We hereby declare our intention to make an application before the constitutional court, to have the Affirmative Action policies of the ANC govt repealed.
