What you are about to read, unfortunately, is NOT unique. Several scenarios identical to this are coming to public attention, and many innocent dogs are being destroyed, and many of those owners are either lower income owners without the means to fight, or in some cases, sadly, unaware of their rights.

On September 29, 2010 Scarlette, a Boxer/Lab cross accidentally wandered off property when the owner's recently injured father mistakenly left the door open. Neighbours found Scarlette, but unsure what to do with her, contacted Oshawa Animal Control. The owner was not contacted that her dog had been found.

The owner, frantically searching for her dog, found her dog's profile on the Oshawa Animal Control's site in the section for animals up for adoption. Relieved, she contacted OAC and was told she could not adopt the dog because it was deemed that it "looked" like a pit bull.

The OAC adoption profile for Scarlette was listed as a pitfull, and the OAC indicated that the adoption profile for Scarlette was an error. Scarlette was not supposed to be placed for adoption.

It was not until 1 week after the owner contacted OAC, did they remove the dog from the adoption site. It was decided that the dog "looked" like a pit bull, which under the BSL in Ontario, automatically placed Scarlette on death row.

The owner was advised of a forthcoming subpoena but was not advised of her right to appeal. During this whole time she was also denied access to her dog, and has not seen her dog since September 29, 2010. Scarlette has now been separated from her owner for 5 months.

On December 23, 2010, several months after her dog was turned over to the OAC, she received a Notice to Appear in court for January 19, 2011. That has now been carried over to February 10, 2011. She has been charged with owning a pit bull, running at large, and notified of a potential fine subject to the terms of DOLA. She has also been informed that her her beloved pet might also be subject to euthanasia, at her expense.

We desperately need your help.

We, the undersigned are requesting urgent investigation and intervention so the owner of Scarlette can have the proper time to prepare her appeal.

Several errors have been made in this case, the owner was not informed of her rights, numerous calls to obtain more information were not returned. There has a been a grievous lack of co-operation.

Please, we ask that you do what is necessary to investigate this case, and intervene on the owner's behalf.
