Give me Water

That almost from about a century the residents of the area were provided water from Uch canal which receives water from Pat Feeder, now under the grip of a severe problem of water pollution ranging from upstream agricultural lands as no drainage facility available there, direct inflow of agricultural waste water (drainage water) into the said Canal, thereby contaminating water and resulting in various types of water borne diseases.

That the inaction of the State in setting up of a the drainage system agricultural waste water directly doing into the Canal causing a serious health and sanitation problem.

That due to the polluted water of Canal the thousands of green land turned into the desert and and arid zones completely destroying the life not any of human being, but animal life as well.

That Water is not used for the purposes of water our agricultural land per se but even it is used as potable.

That it is a well-known fact that clean water is absolutely essential for healthy living. Adequate supply of fresh and clean drinking water is a basic need for all human beings on the earth, people of this area are deprived of this. Now That water has turned into poison because of excess of pesticides in it.

That not a single Department of the State Government is willing to take any responsibility in the matter and are conveniently shifting the burden to another department.

That We have repeatedly made application to the DCO, Irrigation Department, EPA and concerned officials but proved all futile, despite the authority may have been keeping in the mind the likely dangers to inhabitants health and property.

That wherever the upstream land owners asked for the same action they have answered that they have allowed by concerned authority to do so.

That flow of water is slowed down willfully as the waste water can enter into the Canal easily meaning thereby the authority having some terms with upstream land owners with some illegal considerations.

That this action is punishable under Pakistan Penal Code, and Concerned authority failed to perform his duty to take some proper measure to prevent Canal from being polluted.

That there are threats of serious danger , effective measure to be taken to avert a catastrophe.

That In the quest of agricultural development one has to adopt such measure which may not create hazard to the life and property , destroy the environment and pollute the atmosphere.

That Water is crucial for sustainable development, including the preservation of our natural environment and the alleviation of poverty and hunger. Water is indispensable for human health and well-being.

That All the living organisms required a specific amount of water. No life can be possible without the water. There are lots of properties of water which make it essential for life. Water is the medium of life.

That the person entitled protection law from being exposed to hazards of polluted water.

That Whenever the life of the citizens is degraded , the quality of life is adversely affected and health hazard are created affecting the large number of people, the Court in exercise of jurisdiction under Article 184(3) of the Constitution may grant relief to the extent of stopping the function.

That in these circumstances the court may appoint commissioner to examine and study the all situation and report whether there is any likelihood of any hazard or adverse effect on health and property at large .

That the water is necessary for the existence of life , if polluted or contaminated, would cause serious threat to human existence and in such a situation, exposed to such a danger are entitled to claim that their fundamental rights of life guaranteed to them by the constitution has been violated.

That water has been considered source of life in this world without water there can be no life . History bears testimony due to famine and scarcity of water , civilization have vanished.
That the attempts made by the inhabitant about this violation but no satisfactory step has been taken.

That the article of 9 Constitution says No person shall be deprived of life or liberty save in accordance with law.

That the Court may graciously be pleased to directed the State to immediately take necessary steps to prevent and control water pollution and to maintain wholesomeness of water which is supplied for human consumption.
