This petition is being started for a couple of reasons. First, a red nose pit bull named Boost is being discriminated against specifically based on his breed. Boost has already been labeled a "dangerous dog" solely based on him being a pit bull, which in the state of Virginia under law {3.1-796.93:1. Control of dangerous or vicious dogs;penalties; that clearly states as follows: C. No canine or canine crossbreed shall be found to be a dangerous dog or vicious dog solely because it is a particular breed, nor is the ownership of a particular breed of canine or canine crossbreed prohibited. No animal shall be found to be a dangerous dog or vicious dog if the threat, injury or damage was sustained by a person who was (i) committing, at the time, a crime upon the premises occupied by the animal's owner or custodian, (ii) committing, at the time, a willful trespass upon the premises occupied by the animal's owner or custodian, or (iii) provoking, tormenting, or physically abusing the animal, or can be shown to have repeatedly provoked, tormented, abused, or assaulted the animal at other times. No police dog that was engaged in the performance of it's duties as such at the time of the acts complained of shall be found to be a dangerous dog or a vicious dog. No animal that, at the time of the acts complained of, was responding to pain or injury, or was protecting itself, it's kennel, it's offspring, a person, or it's owner's or custodian's property, shall be found to be a dangerous dog or a vicious dog.}
I cannot go into details about this case but I will say that this ruling on Boost is unfair based on the fact that Kim Miller did not even meet Boost before coming to this conclusion or was a statement taken from me at the time of judgment. The routine procedure (according to Animal Care and Control ) is a 10 day quarantine for health reasons, because of this ruling made on Boost, he will not be released after the mandatory 10 days.
Because of this ruling made by Kim Miller of Animal Care & Control, Boost is being held in a room with no access to the outside world. He is visited twice a day to be feed, and once a day so that his kennel can be cleaned and sanitized. Please understand that this ruling is out of the shelters hands that Boost is being kept at. The staff of the shelter is being very supportive & understanding. Second is Boost being labeled as a "dangerous dog". Him labeled as a "dangerous dog" is keeping him (based on the Loudoun County Animal Control & Care rules) from being taken on walks, playing with other dogs, being out side period, and any visits from owners or friends. If the courts find Boost as a "dangerous dog" he will not only have to be registered as one, he would have to wear it, literally. Boost will have to wear a collar at all times that says "I'm a dangerous dog". Boost will also have to wear a mussel when he is outside in public. There are more consequences then what I am listing. For those I'd rather not say at this time. This is cruel and unfair treatment for this loving and welcoming animal. He has no history of violent attacks, nor has he ever intended any harm on anyone or anything.
From the day Boost was born, he has interacted with over 2,000 people, at least 10 a day, of all ages. Anyone who has met Boost knows him as part of the family and knows that he would never act in such a manner that he is being accused of unless provoked and/or felt the need to protect his family. This goes way beyond Boost. This stereotyping of pit bulls has been around long before this incident. If animals could speak the English language than I don't think that this would be acceptable. It already is not acceptable upon humans. This needs to stop, people need to educate themselves on this breed and then educate others.
I ask that you not confuse my argument or my point that I'm stating. The law posted above and the decision that was made without the proper information at hand is my argument.
This petition has changed as of April 18, 2007, 10:05pm. Under the current circumstances this petition is now being used as valid defense in court. For those of you who signed this petition before April 18th, 2007, 10:05pm, don't worry. Considering the petitions set up, your name and comments are marked by date. Therefore any signatures and comments prior to April 18, 2007 will not be valid, unless you have agreed otherwise. Those names who understand that this petition is now being used as a request to appear in court, in front of a judge to speak on Boost's behalf will remain. Those names and comments of the people who cannot appear in court do to prior obligations, will have to be deleted since I just got wind that an affidavit will not hold. I'm sorry. Also by signing below you are stating that Boost has never approached you in a dangerous manner, or inflicted any injury upon you.
Please do not sign this petition unless you have met Boost, and are willing to appear in court to speak on Boost's behalf. Please DO NOT attempt to take matters into your own hands on this subject. I know it's a touchy subject, but this petition is serving it's purpose! This petition is NOT an attack on anyone, any group, or any facility involved with the Boost case. This petition is to show your support and help bring Boost home. Please, this is Boosts life, well-being and reputation at stake. Thank you.
