File Case Against People Responsible for Sale of Overpriced Farmland in Tiwi

In 2012, a parcel of agricultural farmland located at Sitio Baldok, Mayong, Tiwi, Albay was alleged to have been acquired by the local government of Tiwi from Santos Clutatio Jr., half-brother of the ex-mayor, Ami Villanueva.
The sale was said to have been declared illegal by the Department of Agrarian Reform (DAR) in July 2013 as the said land is only covered by a Certificate of Land Transfer (CLT).
DAR prohibits sale of such land to the government, the very same institution that issued the CLT and awarded the land to the seller. CLT is not a certificate of ownership and the holder does not have the absolute ownership and right to sell the land.
It was said that DAR also questioned the selling price of P100 per square meter which it found excessive compared to the current prevailing market value of the land. The land was said to have been acquired at a total cost of P2.7 million.
The land cannot also be acquired from the seller due to conflict of interest as the ex-mayor, who is the half-brother of the seller can put undue influence and use power on its acquisition.
We, the undersigned, call on the Commission on Audit to investigate this alleged illegal and overpriced sale of agricultural land by the half-brother of the ex-mayor to the Municipality of Tiwi.
If found to be true, we would request that appropriate charges be filed against all the parties responsible for the transaction.
