DHA; Permanent residency application process fatally flawed, thousands worldwide affected
- Target:
- South African Parlaiment; SA Department of Home Affairs

- South Africa
Please support our petition for the South African Home Affairs Department to improve their practices in regards to permanent residency and make it fair for all.
Currently thousands of South Africans and their families across the world are effected by a flawed, bureaucratic and unfair residency application process. Most waiting years for their applications to be considered. And in a lot cases people just give up because the financial and emotional hardship becomes unbearable.
Legal action is currently the only way to get priority. Critical Skills and Business Permanent Residency receive priority; because they will be paying higher taxes and bringing in financial benefit - which is great, but short sighted. Retired and Relative applications takes years and are even getting rejected. Never on solid legal grounds, almost always as a result of a mistake, oversight, lack of understanding of requirements, etc. The DHA don't even have performance targets for applications other that Critical Skills and business related applications. This extract from their performance targets report for 2017/18 - 85% of permanent residence applications adjudicated within 8 months for applications collected within the RSA (from date of receipt of application until outcome is in scan at VFS centre - office of application).
(Above applications refer to: critical skills (s27b), general work (s26a) and business (s27c) only). That is shameful.
What the DHA fails to understand is that the people that are being rejected in most cases will contribute to the country's GDP and a lot of spouses of SA citizens join their family in South Africa to set up businesses and improve infrastructure and the economy in South Africa.
Sadly for so many the prospect of joining their loved ones take years and in a lot of cases don't ever happen because the DHA wants you to litigate. Basically if you don't have money you are discriminated against and left in limbo for up to 2-4 years in so many cases. Chasing progress of your application is futile. This is a feature, not a bug.
Please help us stop the prejudice and get a fair process implemented for all South Africans and their families willing and able to return to our beautiful country and be part of the solution.
We, the undersigned, call on the South African Government to take action to review and improve practices and targets within the Department of Home Affairs to allow for a fair, transparent and timely processing of all residency applications
