زندان: تنبیه زندانی یا فرزند او؟
بالا رفتن آمار زندانیان -- صرف نظر از جرم و اتهامی که به آن محکوم شده‌اند -- جنبه‌ای پنهانی و نگران‌کننده به دنبال دارد: کودکان این زندانیان خود به قربانیان فراموش شده تبدیل شده‌اند. با توجه به اینکه آمار دقیقی از تعداد زندانیان موجود نیست، به دست آوردن تخمینی از تعداد کودکان زندانیان در ایران دشوار و حتی ناممکن است.

کودکان زندانیان (افراد زیر 18 سال)، علاوه بررویارویی با مشکلات مشابه کودکان هم سن و سال خود، با سختی‌‌های دیگری هم روبرو هستند: دوری از پدر یا مادر زندانی برای مدتی نامعلوم، دوری از محیط آشنای خانه (برای آنکه تحت مراقبت نزدیکان خود قرار گیرند)، حس اندوه، تنهایی، ترس از دست دادن پدر یا مادر زندانی برای همیشه، گناه، شرم، بی‌اعتمادی، اضطراب، و افسردگی. با توجه به اینکه این کودکان نزدیک‌ترین مراقبین‌شان را در کنارشان ندارند امور روزانه آنها هم دچار اختلال می‌شود و این وضعیت برای کودکان زنان زندانی (که غالباً مراقبت‌های روزمره کودک بر عهده آنهاست) شدیدتر است. کودکانی که سن کمتری دارند گاه با مادر خود در زندان به سر می‌برند و تحت تاثیر مستقیم فضای نامناسب زندان و فشارهای روانی که به مادرشان وارد می‌شوند هستند. علاوه بر این اگر پدر یا مادر زندانی نان‌آور خانواده نیز باشد، این کودکان ممکن است در معرض مشکلات اقتصادی نیز قرار گیرند. در نتیجه کودکان زندانیان به واسطه شرایط اجتماعی و روحی متفاوتی که تجربه می‌کنند نیازمند مراقبت‌های ویژه‌ای هستند و تامین حقوق آنها می‌بایست به طور جداگانه مورد توجه قرار گیرد. زندانی بودن پدر یا مادر نمی تواند دستاویزی برای تنیبه فرزند او نیز باشد. طبق ماده ۹ پیمان‌نامه حقوق کودک، که ایران نیز به آن ملحق شده است، «کودک نمی‌باید بر خلاف میل‌اش از والدین خود جدا شود»، مگر اینکه مسئولان معتمد تصمیم بگیرند که چنین «جدایی منافع عالی کودک را برآورده می‌کند.» نص پیمان‌نامه حقوق کودک بر «منافع عالی» او استوار است و هرگونه اقدامی به این منافع خلل وارد نماید خلاف نیت قانون‌گذار است. به همین خاطر مسئولین زندان می‌باید اقدامات جداگانه‌ای در نظربگیرند تا کودکانی که به ملاقات والدین خود به زندان می‌روند آسیب روحی کمتری ببینند. ما امضا کنندگان این بیانیه برای به حداقل رساندن آسیب‌های روحی و روانی که به این کودکان وارد می‌شود خواهان برقراری امکانات زیر برای کودکان همه زندانیان -- اعم از سیاسی و غیرسیاسی -- توسط قوه قضاییه و صندوق کودکان سازمان ملل متحد در ایران هستیم. - امکان برقراری ملاقات های حضوری مرتب برای کودکان زندانیان با پدر یا مادر زندانیشان - ایجاد فضای مناسب كودكان برای ملاقات – از جمله عدم حضور مامورین با لباس فرم در سالن ملاقات - ورودی مجزا برای کودکان ملاقات کننده، برای آنکه کودکان با نرده های زندان مواجهه نشوند - فراهم آوردن حدالامكان وسایل بازی در سالن ملاقات - استفاده از از رنگهای شاد در فضای سالن ملاقات - امکان ملاقات زندانی با کودکش با لباس شخصی

Statement in support of children of prisoners
Prison: A Punishment for the Imprisoned or for their Children?

The increasing number of prisoners in Iran, regardless of the charges against them or their crimes, has hidden and disturbing consequences on their children. They are the forgotten voices of the bulging prison population. There are no precise figures as to the number of prisoners in the penal establishment.

As such, it is difficult to assess the impact of their absence within the social and familial structure, in general, and on their children in particular. Moreover, children below the age of 18 have to grapple with a whole set of issues that require special attention. These include: absence of imprisoned fathers or mothers for an undetermined period of time; being forced to stay away from their home and familiar surroundings (many are cared for by persons other than their immediate family); despair, loneliness, fear of losing their imprisoned mother or father forever, and feelings of guilt, shame, lack of trust, anxiety, and depression; economic pressures, should the imprisoned mother or father be the main breadwinner.

Because these children do not benefit from the presence of their closest caregivers, they face potentially crippling disruptions in their daily lives. This situation is even more severe for children with imprisoned mothers, as mothers usually shoulder the lion's share of caring for children. Younger children are sometimes housed with their mothers in prison. The unsuitable conditions of prison and the emotional and psychological pressures inflicted on their mothers affect them more severely.

Given the different social conditions and emotional pressures faced by children of prisoners, they require special care. As such, ensuring the rights of the children of prisoners needs special attention. The imprisonment of their parents should not translate as punishment for children. According to Article 9 of the Convention on the Rights of the Child (CRC), to which Iran is a signatory, "a child shall not be separated from his or her parents against their will," unless it is determined that "separation is necessary for the best interests of the child."

The best interest of the child is one of the guiding principles of the CRC. In the case of the children of prisoners, such interest would be best served by initiatives inside the prison that minimize the psychological trauma of children during visits to their parents.

The signatories to this petition request the Judiciary of the Islamic Republic of Iran and UNICEF, to work to minimize the emotional and psychological damage to children of prisoners by ensuring the following conditions for children of political and non-political prisoners:
- Regular in person visits of children with their imprisoned parents and the creation of an appropriate and conducive atmosphere in which these visits take place, including not subjecting these children to the presence of officials in uniform during the visit
- special entrance to prisons for children visiting with their parents to avoid unnecessary exposure to the penal apparatus.
- provision of toys in the visitation rooms
- use of bright and uplifting colors in the visitation areas
- allowing prisoners to visit with their children in regular clothes, as opposed to prison uniform
- allowing prisoners to visit with their children on special dates such as the birthday of children, parents, New Years, etc.
