Bogota Savings Bank accept our payment reinstate our home loan

We are two sisters who are fighting to keep our house. Due to medical issues, we fell behind on our tax payments. The bank went ahead and paid them (without our knowledge). When we did pay our mortgage late, they used that as an opportunity to begin to file for foreclosure. When we did make those mortgage payments up, they applied the payment to pay the new bill they created for the taxes without our knowledge, so it looked like we weren’t paying our mortgage. Is that even legal?

Things are now turning around and we’re starting to get back on track and ... WE NOW HAVE THE MONEY TO PAY THE OVERDUE MONEY BUT THE BANK WILL NOT ACCEPT IT.

Even the judge is trying to help us but the bank is still fighting to take our house. We have the tax money but because the bank and lawyer stands to make more money and get it instantly by foreclosing, they are still trying to take our home. A big shocker is that this is a local bank (Bogota Savings Bank) that is basically trying to steal our house. Not only that, but they have been tacking on all sorts of fees, avoided our requests for breakdown of how they billed us and applied our mortgage payments, and wouldn’t even accept mortgage payments unless they were made in person before and after the foreclosure.

The judge set a new court date so he can review if he has the power to make a judgment that the bank must take the payment and reinstate the loan. He was unable to rule at the time because he had simply never seen an instance when a BANK would REFUSE TO ACCEPT PAYMENT and INSIST ON THE SALE.

Please help us to show support so they will accept payment and let me stay in my home. I am not asking for anything for free or any handouts. Fair is Fair. It is our only mortgage and the bank's equity is secured by the house which is worth much more than the mortgage. We are not even asking for a loan modification because when we did that in mediation, their lawyer said they would not even consider it due to my recent surgery and inability to work. (Isn’t there some sort of law against penalizing legally disabled people?) If this can happen to us, this can happen to anyone. Please support us and do not support this bank that is refusing to accept payment and reinstate our loan.

There is a lot more to this story but instead of slinging mud and talking about the horrific tactics of banks set on foreclosing on properties for profit making, we would like to focus on health and new beginnings. We have the money. Let us keep our home.

The hearing will be TOMORROW, WEDNESDAY OCTOBER 15, 2014 when the Judge will explain if he was able to reverse the foreclosure and reinstate the loan because we have come up with the payment. If he is unable to do so because of the law, we will lose our home unless Bogota Savings Bank sees we have the support of our community.

Please help us put pressure on them and SIGN THIS PETITION TODAY. Let them prove that they are a fair bank worthy of doing business with other families and businesses. Thank you for your time and support!
