PLEASE READ CAREFULLY. Since it is against Federal Law to completely ban the sale of dogs and cats in pet stores, this bill proposes dogs and cats offered for sale in Palm Beach County pet stores must be acquired from local, licensed Palm Beach County breeders only or offer for adoption dogs and cats from local rescue groups and shelters.
Each year, thousands of animals are euthanized in our county shelter and private not for profit animal rescue groups. Each year, thousands of animals are imported into our county via pet stores and offered for sale.
Palm Beach County has a breeding ordinance but has not addressed the pet overpopulation in this county due to the increased 'spur of the moment' purchases of dogs and cats in pet stores brought in from out of county and out of state, as well as, these animals not being sterilized once bought by the public.
I propose an ordinance to ban the sale of puppies and kittens in pet stores in Palm Beach County acquired from out of Palm Beach County or out of the state of Florida. This will force the public to seek other avenues to purchase their new family members through reputable breeders, hobby breeders or local animal rescue groups and shelters.
This will reduce the number of animals being brought into our county each year and reduce the number of animals that must be euthanized each year.
This bill asks that any dog or cats sold from private hobby or commercial breeders directly to the public must be sold from the location listed on the breeder permit. It also asks that any dog or cat offered for sale from a pet store must be obtained from a hobby or commercial breeder located within Palm Beach County. The pet stores may also offer for sale any dog or cat obtained from an animal control agency, shelter or animal rescue organization located within Palm Beach County.
We the undersigned, call on the County Commissioners of Palm Beach County, FL to ban the sale of puppies and kittens in pet stores in Palm Beach County, FL.
Sale and display of animals.
(a) A person shall only sell, offer for sale, barter, give away or otherwise dispose of an animal at the physical address listed on the appropriate permit issued by the county manager. Shelters shall be allowed off-site adoption events, with permission of site owner and while preserving appropriate care and maintenance of animals.
(b) No person shall offer an animal as a prize, giveaway or award for a contest, game, sport or as an incentive to purchase merchandise.
(c) Animal exhibits.
(1) No person shall operate, conduct, or maintain a permanent or temporary commercial animal show, circus, animal exhibition, animal ride, petting zoo or carnival without first having obtained a permit from the animal care services department. Conditions for permit approval include provisions for the humane care and treatment of the animals and the protection of public safety. Permits shall not be issued upon verification that within the preceding 12 months the applicant has been convicted of charges of animal cruelty, abuse, or neglect, or has violated the Federal Animal Welfare Act.
(2) No person shall operate, conduct or maintain any animal exhibit under conditions that pose a danger to the public or the animals. Specific requirements shall be available upon request to the animal care services department.
(3) The following are exempt from the requirements of this section:
(i) Individuals or groups holding a State of Florida regulated permit or a federally regulated permit.
(ii) Events sponsored by a municipal zoo or aquarium facility.
(iii) Competitive sporting events.
(4) Persons involved in these exempt activities shall comply with all other applicable sections of this chapter.
(d) Sale of live cats and dogs at pet stores. The sale of live cats and dogs at pet stores is prohibited unless the live dogs and cats available for sale are purchased from local hobby and/or commercial breeders in Palm Beach County, FL with an approved hobby or commercial breeding permit from Palm Beach County Animal Care and Control. No dogs or cats shall be offered for sale in any pet store in Palm Beach County which were born outside of the County or through a hobby or commercial breeder who does not hold a Palm Beach County breeder permit. Pet stores may also offer for sale any dog or cat obtained through an animal control agency, animal shelter or animal rescue organization located within Palm Beach County.
