The Canadian Constitution contains no provisions for Animal Rights, regarding, instead, non-human animals as “property”, to be treated in any manner whatsoever.

Some Provincial laws, on the other hand, date back to Confederation, while the Cruelty to Animals Provisions of the Criminal Code were written in 1892.

The Constitution and Criminal Code, therefore, must be revised to include non-human species as “sentient” beings, protected from pain, fear, abuse, cruelty and suffering at the hands of humans, just as we are protected from the same. Canada has a duty to use the existing power of the courts to reinstate our culture of compassion and anti-cruelty values.

We, the undersigned, call on Prime Minister Stephen Harper and Minister of Justice and Attorney General of Canada, Robert Nicholson, to include in the Canadian Constitution and the Criminal Code of Canada, recognition of non-human animals as “sentient” beings, protected from fear, pain, cruelty, and abuse, of any kind, at the hands of humans. We further suggest, that our government adopt standards that meet, or exceed, those of the international community.
