The 15th branch of the Revolutionary Court in Tehran found Amir Reza Arefi guilty of Moharebeh, and based on articles 186, 187, 189, 190, 191 and 46 of the Islamic Penal Law sentenced him to death.
The 21-year-old Arefi is married and was arrested before the June presidential election on April 15th, 2009.
Arefi's lawyer, Mohammad Mostafai, said the 21-year-old man was sentenced in Tehran on February 17. The revolutionary court also ruled that Arefi tried to plant bombs at polling stations during the presidential election in June; But Arefi was arrested two months before the vote was held.
The 15th branch of the Revolutionary Court has found my 21-year-old client guilty of Moharebeh for his alleged membership in the Anjoman Padeshahi (an exiled monarchist group) and based on articles 186, 187, 189, 190, 191 and 46 of the Islamic Penal Law, has sentenced him to death.
Mostafaie and his client have 20 days to file an appeal.

We the petitioners are calling for an immediate halt to the execution of Amir Reza Arefi and for the immediate dismissal of charges of 'Moharebeh' on the grounds that; the defendant had been incarcerated since April 15th, 2009 and in the custody of the IRI at the time of the alleged crime and therefore could not have been involved in any activities during the June 2009 election.
We call for the immediate release from prison of Amir Reza Arefi as the charges are a complete fabrication and without just cause.
We also call on the Head of the Judiciary, Sadeq Larijani to investigate the source of these fictitious charges, and to hold those responsible accountable for falsifying state documents, and charge them for their crime in perpetrating these injustices and thereby causing severe emotional distress to the victim and his family.
Furthermore we call on Ayatollah Ali Khamenei and Sadeq Larijani to halt all mock trials and release all political prisoners including; Students, Journalists, Women's Advocates, Religious Minorities, Trade Union Representatives, Human Rights workers and illegally detained foreign nationals and to comply with IRI State and International Laws and Treaties concerning due process of law and human rights.

ما امضا کنندگان این دادخواست، خواستار توقف فوری حکم اعدام امیررضا عارفی و نیز تکذیب فوری اتهام محاربه به وی هستیم. نامبرده از تاریخ 26 فروردین 1388 زندانی و در زمان ارتکاب جرم مورد بحث در زندان جمهموری اسلامی محبوس بوده و بنابراین قادر به شرکت در هیچ گونه فعالیتهای پس از انتخابات ریاست جمهوری خرداد ماه نبوده است.
ما همچنین خواستار آزادی فوری امیررضا عارفی از زندان هستیم زیرا باور داریم اتهامات تفهیم شده به نامبرده کاملا ساختگی بوده و دلیل محکمه پسندی برای این اتهامات وجود ندارد.
ما همچنین از آیت الله صادق لاریجانی، رئیس محترم قوه قضائیه درخواست می کنیم که منابع این اتهامات ساختگی را بررسی کرده، افراد مسئول در تحریف اسناد دولتی را شناسایی و آنها را به جرم ارتکاب این بی عدالتی ها و در نتیجه ایجاد پریشانی روحی شدید در متهم و اعضای خانواده وی، مجازات نمایند.
همچنین، ما از آیت الله علی خامنه ای و آیت الله صادق لاریجانی درخواست می کنیم تمام محاکمات ساختگی را متوقف کرده و همه زندانیان سیاسی، از جمله دانشجویان، روزنامه نگاران، فعالان حقوق زنان، اقلیت های مذهبی، نمایندگان اتحادیه های کارگری، فعالان حقوق بشر و اتباع خارجی را که به طور غیر قانونی بازداشت شده اند، آزاد کرده و مطابق با قوانین دولت جمهوری اسلامی ایران و قوانین و تعهدات بین الملل به رعایت قوانین و حقوق بشر در اجرای آیین دادرسی عمل نمایند.
