The Medical Board of Australia is the body of people who make the decisions on public complaints to Australian Health Practitioner Regulation Agency (AHPRA) regarding any Australian medical practitioner.
The Ministerial Council is responsible for appointments to the Medical Board of Australia and all of the entities mentioned in this petition operate under a National Scheme - meaning they affect every Australian citizen.
In short, the aims and objectives of the Scheme is to provide all Australians with a high standard of health care and legislation requires any person having function under the Scheme to comply with Health Practitioners Regulation Law Act in the execution of their duties. However, without legal expertise a layman does not stand much chance of enforcing compliance.
At the present time representatives of AHPRA involved in the public cases, and, members of the Medical Board of Australia are not required to take a mandatory OATH OF IMPARTIALITY before being placed in these positions - positions where impartiality should be a base-line requirement.
If individual representatives of AHPRA and the Medical Board of Aust cannot be trusted by the public to protect them from unethical practitioners by making fair and impartial decisions [favouring no side, simply considering the evidence] the aims of the Scheme are in serious jeopardy as is the standard of health care for all Australians.
I have a mountain of evidence that blatant lies by an Australian surgeon about his dealings with his patient are acceptable to AHPRA and the Medical Board of Aust, without question and without investigation.
From my dealings with this surgeon, Health Quality Complaints Commission (HQCC), AHPRA, the Medical Board of Aust, Queensland Civil Administrative Tribunal (QCAT), solicitors for the Medical Board and solicitors for the surgeon, it is clear there is a lack of integrity within the medical profession, and, the entities appointed by the Government to investigate public complaints.
I believe legislation should be updated to include a mandatory OATH OF IMPARTIALITY be taken before appointment to positions which require impartiality, and, the individuals be held accountable for the decisions they are making.
Evidence and relevant documents which include;
3 letters to the Ministerial Council,
the Hon Lawrence Springborg MP's reply,
complete HQCC and AHPRA case files,
letters to the Office of the Health Practitioner Ombudsman, and
QCAT and Supreme Court documents provided to solicitors for the Medical Board of Aust;
can all be viewed by emailing me at: kachiri@dodo.com.au.
It be mandatory for representatives of AHPRA involved in all cases regarding public complaints and members appointed to the Medical Board of Australia to take an OATH OF IMPARTIALITY before being placed in these positions AND be held accountable for the decisions they are making.
