The Tenth Amendment provides that “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
In Accordance to the Constitution of the State of Nebraska Preamble and Article I, CI-1 and Article I, CI-26 of the Nebraska Constitution, it also Clearly states:
Preamble
We, the people, grateful to Almighty God for our Freedoms, Do Ordain and Establish the following Declaration of Rights and Frame of Government, as the Constitution of the State of Nebraska
Article I, CI-1 Statement of Rights
All persons are by nature free and independent, and have certain inherent and inalienable rights; among these are life, liberty, the pursuit of happiness, and the right to keep bear arms for security or defense of self, family, home and others, and for lawful common defense, hunting, recreational use, and all other lawful purposes, and such rights shall not be denied or infringed by the state or any subdivision thereof. To secure these rights, and the protection of property, governments are instituted among people, deriving their just powers from the consent of the governed.
Article 1, CI-26 Powers Retained by the People
This enumeration of rights shall not be construed to impair or deny others, retained by the people, and all powers not herein delegated, remain with the people.
It is our belief that the federal government has consistently over-stepped its constitutional boundaries and usurped the powers reserved to the states, and therefore the people.
A Nebraska Sovereignty Resolution will remind the federal government of its proper role and place.
Is Nebraska alone in this movement? The answer is no. There are no less than 32 states that are claiming and/or planning similar legislation.
Our goal is to have a resolution adopted and passed by the Nebraska State Legislature during the calendar year 2009.
