And think how many times she was in danger but Phoenix helping her.
Not only that she is a FAMILY to Phoenix. You can't just ignore her like that in the game.
She is someone special to him, might not be to the level of lovers, but there is a bond between them that just cannot be broken. By not putting Maya in the game, it is obvious that they are excluding the fact that she is an important figure for Phoenix.
Not only that, Mia told Phoenix that they WILL meet again. Now, who's going to help with that? The mysterious new girl? I don't think so.
So then what reason would there be to not put her in? If the company is going to say that the the "characters are still meeting each other even if they are no on the screen", then that is some seriously stupid thing to say.
We are players that uses game device, and to know if the character is still alive or not, they have to say SPECIFICALLY the name of the character that is missing in the game, or at least SHOW them.

The game wouldn't feel complete without her with Nick being the main character. It would be a shame to see such a well written and integrated character to leave with out proper closure. I feel that it is VERY important to the PW franchise that this character gets proper closure and believe that the next game is the best time to do so. I as a PW fan would be extremely upset if capcom ignores Maya in this upcoming game.
