#Noise Nuisance

We, the undersigned, would like to bring your attention to the following problem, with the recommendation(s):
A continuous noise nuisance has occurred from the property of 1161 Worthington Road Owensboro, Kentucky 42301, where the Business All Paws Claws and Hooves is located. Up to fourteen Dogs are outside at any given time (Between the hours of 7am to 7pm) barking excessively. We demand that All Paws Claws and Hooves cease this nuisance by relocating, or shutting its doors.
All petition signers are located in the area, and/or have been affected by the nuisance stated above. We recognize this as an issue and though we may not be affected directly, it is affecting our neighbors and our community. Please print legibly.

The unnecessary noise levels have increasingly become more of a nuisance over the years, due to the business growing. In May of 2017, Kennel owner, Trina Mack, received a request to put the dogs inside for a special occasion taking place outdoors. Ms. Mack had been compliant with such requests previously. Ms. Mack did not comply, and stated she would no longer work with neighbors. As a result, two criminal complaints were opened against her by the direct neighbors. This caused the County Attorney, Claud Porter, to send Ms. Mack a letter advising her to stop the nuisance immediately.
Ms. Mack is knowingly violating the Daviess County Ordinance, Chapter 4: Article II – Sec. 4-17 which states: It shall be unlawful for any owner or person in charge of an animal to suffer or permit on his premises the loud or frequent barking, howling or yelping of such animal so as to annoy or disturb any neighborhood located in the county, or any city therein.
The Daviess County Sheriff’s Department has been called to the home, so far, 12 times. Ending with two citations being handed to her by the Daviess County Sheriff’s Department, for violating the County Ordinance. These violations are currently being handled in Criminal Court.
Allowing these dogs to bark uncontrollably and for such long periods of time, interferes with the peace and comfort of surrounding neighbors and their guests. Excessive barking is inconsiderate, and shows a complete lack of respect for your neighbors.
Demanding All Paws Claws and Hooves to either relocate, or shut its doors will bring peace to the area and allow for others to enjoy the comfort of their backyard. A stress free environment is something all homeowners/tax payers deserve.
