On April 19, 2008, Elisha Prien of Agar, South Dakota let her 3 dogs outside to "potty" after a bath, after 5 min. she called to them and only 1 returned. She continued to look and call for them throughout the day. On 4/20/08 her husband, Jeremy, asked a neighbor about them due to threats made in the past by him, he denied any knowledge, Elisha left a message a County Sherriff dept. and Sherriff called 20 min later and said that HE had shot the dogs due to them being agressive when he approached them as they were "eating on a dead deer", had NO remorse and became agaitated when questioned, changing his story several times. Dogs were found approx. 100 ft from deer, both shot in the abdomen and left for dead.
We, the undersigned, call on all pet owners and animal lovers to have Sully County, South Dakota, Sherriff Bill Stahl held accountable for the murder of 2 dogs owned by Elisha and Jeremy Prien of Agar, SD.
Sherriff Stahl admitted to shooting the dogs and when found, they had been shot in the abdomen causing severe pain and agony for them while they lay in an open field until they died at unknown time.
We feel that Sherriff Stahl should be charged with criminal charges and be suspended from his position as Sherriff of Sully County.
Shooting them is in violation of SD statutes:
40-1-12 Allowing fatally injured or diseased animal to suffer needlessly prohibited -- Violation as misdemeanor.
No person may keep any animal which is injured or diseased, past recovery, or unfit for any useful purpose and in suffering, or intentionally abandon to die any sick or disabled animal. A violation of this section is a Class 1 misdemeanor.
40-1-21 Killing or injuring animal of another as misdemeanor -- Authorized euthanasia excepted.
No person may intentionally kill any animal of any age or value, the property of another, nor intentionally injure any such animal. A violation of this section is a Class 1 misdemeanor. This section may not be construed to prevent euthanasia by a licensed veterinarian with proper authority from the animal's owner nor may it prevent acts of euthanasia authorized by this chapter. This section may not be construed to prohibit euthanasia conducted by the municipality or under a municipality's animal control activities. This section may not be construed to prohibit activities conducted under chapter 40-34.
Shooting them in the abdomen caused unneccessary suffering and is in direct violation of this statute. Please support this petition with your signature and let Sully county know that this is NOT acceptable!
