On December 15, 2013, Jake Anderson, a 19 year old freshman in college, fell and did not survive. His family was not able to gain access to his cell phone, email or other digital data due to privacy laws.
The case was ruled accidental, not criminal, and there were limits to what access was provided.
In this, and other similar cases going forward, the family would like to see legislation drafted that allows the personal representative of the deceased, such as an executor of the will or surviving beneficiaries, to gain access to, but not control of, a person's digital files so long as the deceased did not prohibit this in their will.
We, the undersigned, support the need for legislation to allow a personal representative of the deceased, access to (but not control of) the deceased individual's social media, digital and cell phone data.
